Terms of Use
Last updated October 16, 2026 (version 2026-10-16.2)
These terms are an agreement between you and Crossing Watch, operated by Nevo Kamrat ("we", "us"), for the Crossing Watch website, phone apps and Premium subscription (the "service"). By using the service you agree to them. If you do not agree, do not use it. You must be 18 or older to create an account or buy Premium.
Not a safety device
Crossing Watch is a driving aid, not a safety device. It does not replace railroad crossing signals, gates, signs, train horns or your own attention. Train times are estimates. Alerts and times can be late, wrong or missing, for example because of GPS errors, phone settings, battery saving, no network, a closed app, or because a train was never seen. Freight train times are estimates from indirect sources; many freight trains are never seen, and freight trains are not alerted. No alert or no listed train never means that no train is coming. Always obey the crossing's signals, look both ways, and never handle your phone while driving.
Rail safety rules you agree to
- All train arrival times are estimates. A train can come earlier, later, or when no time is shown at all.
- Never stop on railroad tracks to take photos. Take photos for a train report only from a safe, legal place off the road and well back from the tracks, never while driving.
- Never stop on railroad tracks because no train is estimated. A crossing with no listed train is not a safe place to stop: a train can come at any time.
Your responsibility and assumption of risk
You use the service at your own risk. You are responsible for how you drive and for obeying traffic and railroad laws. You agree not to rely on the service to decide whether it is safe to cross railroad tracks.
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF ACCURACY, TIMELINESS, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS. The service uses data from third parties that we do not control and that may be incomplete, delayed or wrong.
Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM RELIANCE ON TRAIN TIMES, ESTIMATES OR ALERTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR US $50. Some places do not allow some of these limits; there, they apply as far as the law allows.
Indemnity
You agree to defend and indemnify us against claims arising from your misuse of the service or your breach of these terms, including using the service in a way that breaks traffic or railroad laws.
Premium subscription
- Premium is an auto-renewing subscription, monthly or yearly, at the price shown before you buy. It renews automatically at that price until you cancel.
- On the website, payment is handled by Stripe. Before checkout you confirm that you agree to these terms and to the automatic renewal, and you get a confirmation email with the price, the renewal terms and how to cancel. Cancel any time on your account page (Manage subscription): you keep Premium until the end of the period you paid for and are not charged again.
- In the iPhone app, payment is charged to your Apple Account, and Apple's standard Licensed Application End User License Agreement also applies. The subscription renews automatically unless canceled at least 24 hours before the end of the current period. Manage or cancel it in your App Store account settings.
- In the Android app, payment is charged to your Google Play account. The subscription renews automatically until you cancel it in Google Play > Payments & subscriptions.
- Premium features depend on public data sources; if a source stops publishing, the related feature may become unavailable. Prices can change; a new price applies only from your next renewal, after we tell you in advance.
Refunds
- Web purchases: you can cancel any time to stop future charges. Payments for a period that has started are not refunded, except where the law requires it. If you were charged by mistake (for example twice, or after you canceled), email us within 30 days and we will refund that charge.
- App purchases: refunds are handled by Apple or Google under their policies.
Acceptable use
Do not misuse the service: no automated scraping, no attempts to break or overload it, and no reports, photos or videos that are false, unlawful, or show other people's private information. Do not go onto railroad property or tracks to take photos or videos. We may remove content and suspend access for misuse.
Your reports, photos and videos
If you send a report, photo or video, you confirm you have the right to share it and you allow us to use it to run and improve the service (for example to estimate train times), and to show it in the service without its location metadata. See the privacy policy for how long it is kept.
Copyright complaints
If you believe something in the service infringes your copyright, email crossingwatch.support@gmail.com with the material, where it appears, your contact details, and a statement that you believe in good faith the use is not authorized. We will review and remove material where appropriate.
Not affiliated
Crossing Watch is independent. It is not affiliated with, endorsed by or sponsored by any railroad (including Brightline, Florida East Coast Railway, CSX, Norfolk Southern, Amtrak, SunRail or Tri-Rail), the Florida Department of Transportation, the Federal Railroad Administration or any other government agency. Names are used only to identify the trains and data shown.
Changes and ending
We may change these terms; the date above shows the latest version, and for important changes we will ask you to agree again in the app or before your next purchase. We may change or stop the service. You can stop using it at any time and delete your account on your account page.
Law
These terms are governed by the laws of the State of Florida and applicable U.S. federal law. Disputes will be heard in the state or federal courts located in Florida, unless the law where you live requires otherwise.
